Broken Crimp (“the app”) is published by Broken Crimp, an independent developer (“we”, “us”). By using the app you agree to these terms. If you do not agree, do not use the app.

1. Safety warning — read this

Climbing is dangerous.

Rock climbing, sport climbing, bouldering and all related activities carry an inherent and unavoidable risk of serious injury, permanent disability and death. That risk cannot be eliminated. By using this app you accept that risk yourself.

The app is a notebook, not instruction. Broken Crimp lets you draw and store your own diagrams of climbs. It does not teach climbing, it does not assess risk, and nothing in it is professional instruction, coaching or safety advice. It is not a substitute for training from a qualified instructor, for a competent climbing partner, or for your own judgement.

The drawn climber is an illustration, not a demonstration. The app draws a figure on the wall and plays your sequence back with it. That figure is generated from the holds and limbs you recorded, at a size you choose. It is not a model of your body, it is not a coach, and it does not show correct or safe technique. A position the figure can be drawn in may be one you cannot reach or should not try.

A beta map describes a sequence of moves and nothing else. It says nothing about whether a climb is safe for you, whether the holds are sound, whether the protection or bolts are adequate or in good condition, whether the landing is safe, whether the pads and spotters are sufficient, or whether the climb is within your ability.

Content in the app may be wrong, out of date, or unsafe for you.

  • Holds break, spin and wear out. Rock breaks. Bolts and anchors age and fail.
  • Gym routes are stripped and reset. A beta map of a gym problem may describe holds that are no longer on the wall.
  • Conditions change with weather, temperature, seasoning and traffic.
  • A sequence that works for one climber may be dangerous for another with different height, reach, strength, flexibility, experience or injury history.
  • Beta shared with you by another person is their content. We do not review, verify, endorse or check any of it. We have no way to know whether it is accurate or safe.

You are responsible for your own safety. Before and while climbing, you alone are responsible for assessing the climb and the conditions, inspecting your equipment, checking your knots, harness, belay and anchors, judging your own ability and fitness, choosing competent partners, and deciding whether to climb at all. Always follow recognised safety practice and the rules of the venue you are at.

Do not use the app while climbing in a way that compromises your safety — do not read your phone while belaying, while on lead, or anywhere that a lapse in attention could hurt you or someone else.

2. No warranty

The app is provided “as is” and “as available”, without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that any content in it is accurate or complete.

3. Limitation of liability

To the fullest extent permitted by law, we are not liable for any injury, death, loss, damage or expense arising out of or connected with:

  • your use of the app, or your inability to use it;
  • any climb, move or sequence you attempt, whether or not it was recorded in the app;
  • any beta, diagram, photograph, note or other content created by you or by anyone else, whether accurate or not;
  • any loss or corruption of data stored in the app, or any failure of a backup or export.

You use the app and you climb entirely at your own risk.

Nothing in these terms limits or excludes liability that cannot lawfully be limited or excluded — including liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or any other liability that applicable law does not allow to be excluded. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you. You may have statutory consumer rights that these terms do not affect.

4. Your content

Anything you create in the app — climbs, beta maps, photographs, voice notes, notes — remains yours. We claim no ownership of it and, as described in the Privacy Policy, we never receive a copy of it.

You are responsible for what you create and for what you choose to share. Do not use the app to record or share anything unlawful, or anything that infringes someone else’s rights. If you photograph a climbing wall or a person, make sure you are permitted to do so and respect the rules of the venue.

If someone sends you a .beta file, treat its contents as that person’s opinion about a climb, not as fact.

5. Your data is on your device

The app stores your climbs on your device. If you lose your device, delete the app, or clear its data, that content is gone. Use the backup feature and keep your own copies of anything you care about. We cannot recover anything for you, because we never had it.

6. Advertising

The app is supported by advertising served by Google AdMob. We do not control which ads are shown and do not endorse any advertiser or anything they offer. Your dealings with an advertiser are between you and them. See the Privacy Policy for what advertising means for your data.

7. Changes

We may update the app and these terms. If we change these terms, the “last updated” date above will change. Continuing to use the app after a change means you accept the updated terms.

8. Governing law

These terms are governed by the law of England and Wales, and you and we agree that the courts of England and Wales have non-exclusive jurisdiction over any dispute.

This does not take away rights you have as a consumer. If you live somewhere else, you keep the protection of any mandatory consumer protection rules of the country you live in, and you may bring proceedings there.
